Reckless driving puts innocent lives at risk. If you ever see anyone driving unsafely, call our police department. Let’s make our roads safe together.
In California, reckless driving is a misdemeanor offense under Vehicle Code § 23103 VC. The suspects face the following possible penalties:
- Jail time
- Up to 90 days in county jail for a first offense
- Fines
- Up to $1,000 plus court fees and penalty assessments
- Driver’s license points
- 2 points added to their DMV driving record
- Can lead to license suspension if too many points accumulate
- Vehicle impoundment
- Law enforcement may impound the vehicle for up to 30 days (as already done in this case)
- Probation
- Court may impose informal probation with conditions such as safe driving classes or community service
- Insurance consequences
- Significant increase in auto insurance premiums
- Possible cancellation of coverage
- Enhanced penalties
- If reckless driving causes injury, it can be charged as a felony with up to 3 years in state prison
- If it causes great bodily injury, additional sentence enhancements apply
In this case, since no injuries were reported, the charges are most likely misdemeanor reckless driving, but the court will still weigh their age, driving history, and the dangerous circumstances (high speed, swerving, near collisions) when determining penalties.
