Penalties for Repeated Restraining Order Violations in California

In California, violating a restraining order is a serious offense under Penal Code 273.6. The penalties for repeated violations can be quite severe:

  • First Violation: Typically charged as a misdemeanor, punishable by up to 1 year in county jail and/or a fine of up to $1,000.
  • Repeated Violations: If you have a prior conviction for violating a restraining order and are charged again, especially if the case involves violence or threats of violence, it can be charged as a felony. This is punishable by up to 3 years in jail or prison and/or a fine of up to $10,000.

It’s important to comply with all terms of a restraining order to avoid these serious consequences. If you have any specific concerns or need legal advice, consulting with a legal professional would be a good step.
