A search of the vehicle uncovered approximately 4 ounces of methamphetamine, a significant amount of U.S. currency, over 100 small plastic baggies, and two digital scales.
The suspect was arrested and now faces felony drug charges. In California, the penalties for selling drugs and being caught with 4 ounces of methamphetamine can be quite severe. Here’s a breakdown of the potential consequences:
Selling Drugs
Under California Health & Safety Code § 11352, selling or transporting controlled substances (excluding methamphetamine) is a felony. However, for methamphetamine, the relevant statute is Health & Safety Code § 11379:
- Penalties: 2, 3, or 4 years in state prison and/or fines up to $20,00012.
Possession of Methamphetamine
Possession of methamphetamine for personal use is typically a misdemeanor, but possession with intent to sell is a felony under Health & Safety Code § 11378:
- Penalties: 16 months, 2 years, or 3 years in state prison34.
Combined Offenses
When combined, these charges can lead to compounded penalties. For example, possessing 4 ounces of methamphetamine with intent to sell can result in a felony charge with significant prison time and fines.
Given the complexity and severity of these charges, it’s crucial to seek legal advice from a qualified attorney who can provide guidance based on the specifics of the case.
