A man was fatally last Friday night in Garden Grove

On Friday, 2/21/25, at approximately 11:20 p.m., police officers were dispatched to a parking lot near 9622 Garden Grove Blvd. regarding a shooting that just occurred, according to the Garden Grove Police Department.

When the officers arrived on scene, they located one male victim with a gunshot wound to the head.

The GGPD officers rendered medical aid until OCFA paramedica arrived at the scene.

The victim was transported to a local hospital where he ultimately succumbed to his injuries yesterday, 2/24/25.

The investigation is ongoing and no additional information is available at this time.

In California, fatally shooting someone while committing a crime typically falls under the felony murder rule. This means that if someone is killed during the commission of certain felonies, the perpetrator can be charged with first-degree murder, even if the killing was unintentional 12.

The penalties for first-degree murder in California include:

  • 25 years to life in prison.
  • Life in prison without the possibility of parole if there are special circumstances, such as multiple victims or the killing of a police officer12.

In some cases, the death penalty may also be considered 2.

If the shooter was a gang member, the penalties can be even more severe. Under California law, specifically Penal Code Section 190.2(a)(22), if a murder is committed by an active participant in a criminal street gang and is carried out to further the activities of the gang, it is considered a special circumstance 12.

This can lead to:

  • Life in prison without the possibility of parole.
  • The death penalty in some cases 2.

These enhanced penalties reflect the state’s effort to combat gang-related violence more aggressively.
